At Rescue Dog Day, we respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act, Title 17, United States Code, Section 512(c), a copyright owner or their agent may submit a takedown notice to us via the methods listed below.

DMCA Notice

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our site, please notify our copyright agent, as set forth in the DMCA. For your complaint to be valid under the DMCA, you must provide the following information in writing:

  • An electronic or physical signature of a person authorized to act on behalf of the copyright owner;
  • Identification of the copyrighted work that you claim has been infringed;
  • Identification of the material that is claimed to be infringing and where it is located on the Service;
  • Information reasonably sufficient to permit Rescue Dog Day to contact you, such as your address, telephone number, and e-mail address;
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law; and
  • A statement, made under penalty of perjury, that the above information is accurate, and that you are the copyright owner or are authorized to act on behalf of the owner.

Only DMCA notices should go to our DMCA Agent. Any other feedback, comments, or other communications should be directed to our standard support contacts as identified on our website.

4. Action on Infringement

Upon receiving a proper DMCA notice, Rescue Dog Day will:

  • Remove or disable access to the allegedly infringing material;
  • Notify the content provider who is accused of infringement that we have removed or disabled access to the applicable material; and
  • Terminate repeat offenders’ access to our site.

Counter Notices

If you believe your own copyrighted material has been removed from our site as a result of a mistake or misidentification, you may submit a written counter-notification to [DMCA Agent Email]. To be a valid counter-notification under the DMCA, your written correspondence must include:

  • Identification of the material that has been removed or disabled and the location where the material appeared before it was removed or disabled;
  • A statement that you consent to the jurisdiction of the federal court in which your address is located, or if your address is outside the U.S., for any judicial district in which the service provider may be found;
  • A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled;
  • Your physical or electronic signature; and
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if your address is outside of the U.S., for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
