4. Action on Infringement
Upon receiving a proper DMCA notice, Rescue Dog Day will:
- Remove or disable access to the allegedly infringing material;
- Notify the content provider who is accused of infringement that we have removed or disabled access to the applicable material; and
- Terminate repeat offenders’ access to our site.
Counter Notices
If you believe your own copyrighted material has been removed from our site as a result of a mistake or misidentification, you may submit a written counter-notification to [DMCA Agent Email]. To be a valid counter-notification under the DMCA, your written correspondence must include:
- Identification of the material that has been removed or disabled and the location where the material appeared before it was removed or disabled;
- A statement that you consent to the jurisdiction of the federal court in which your address is located, or if your address is outside the U.S., for any judicial district in which the service provider may be found;
- A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled;
- Your physical or electronic signature; and
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if your address is outside of the U.S., for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
